  1. The SPSS software is available for use by recognised educational institutions of the Licensee.
  2. Authorised End Users are defined as employed faculty and employees of the recognised Licensee.
  3. You may use the SPSS software at a recognised educational institution or at your principal residence.
  4. Use at your principal residence is limited to use related to course work, non-commercial research or other work directly related to your relationship with recognised educational institution.
  5. You may not sell, assign, lease, sublicense, give, lend, pledge, rent or otherwise transfer to a third party all or any portion of the Software.
  6. Your right to use the software under this agreement will terminate if and when you cease to be an Authorised End User of recognised education institution.
  7. If you cease to be an Authorised End User you shall have the right to purchase a personal copy of the Software from IBM Pty Ltd at a price set by the Company provided you can provide proof of former employment during the term of the license agreement.
  8. The software may be used only during the term of license agreement. The term of the current calendar year.
  9. At the expiry of the license you will cease to use the software and documentation and will remove it from your computer(s) if another agreement has not been entered into.

"Faculty" shall mean any personnel duly engaged by the Licensee to teach or instruct Students and/or to conduct non-profit research on behalf of the Licensee

"Educational Institution" means as an educational institution or establishment, being a higher education institution at which any person or body of persons provides, or offers to provide, courses of instruction and which is a government, non-government, public or private, correspondence school, junior college, college of education, university, scientific or technical institution, polytechnic, academy or religious school meeting all of the following criteria: (i) organised and operated primarily for the purposes of teaching its students; and (ii) lawfully established, authorised, created, licensed, registered and/or accredited, but excludes any institution or established conducted, or proposed to be conducted, for the profit, direct or indirect, of any person. An institution or establishment is not an Educational Institution for the purposes of the IBM Academic Program which conducting any activity for the profit, direct or indirect of any person.

Licensee and IBM agree that the use of the software products listed in this schedule shall be subject to the terms and conditions of the Software License Agreement attached or previously executed.

Schedule 1

  1. Definitions
  2. For the purposes of this schedule, the terms listed below shall have the following meanings:

    "Authorised end user" shall mean any person that is affiliated with Licensee as (i) a full-time employee; or (ii), a full-time or part time faculty member.

    "Site" shall mean the specific geographic locality wherein is situated a single organisational entity. A specific geographic locality may be a building, a building complex, an academic complex, or a corporate office. IBM reserves the right to determine whether given locality and organisational entity shall be considered a site. For the purposes of this agreement site is limited to the locations listed in Appendix 1.

    IBM grants licensee the right for an authorised end user to use the software at the site specified in the schedule.  For the purposes of this agreement site is limited to the locations listed in the schedule(s) and Appendix 1.

    All software under this agreement is to be used by authorised end users on computers which are a) owned or leased by Licensee or b) controlled by Licensee or c) in the case of full time or part time employees on a home computer at their principal place of residence.

  3. Additional License Grant Terms

In addition use of the software is limited to:

  1. Teaching;
  2. Personal educational development;
  3. Administration and management of the business of the Licensee's organisation;
  4. Non-commercial research;
  5. Development work associated with any of the above

Please note: students (including post graduate students) are not permitted to access the software from home.

Restrictions on Use
The software may only be used for Non-Commercial Academic Research and Teaching.

Non-commercial academic research means research by degree seeking students and faculty members where:

  1. the results of such research are not intended primarily for the benefit of a third party;
  2. such results are made available to anyone without restriction on use, copying or further distribution; and
  3. any copy of any such result is finished for no more than the cost of hosting, reproduction, and shipping.

Use of SPSS for Commercial Research is a breach of the university's licence agreement and strictly prohibited.
